Tara Mapes Fine Art Photography AKA Enchanted Eye Creations®

Please read these terms and conditions ("terms", "terms and conditions") carefully before purchasing Tara Mapes' Masterclass (the "course") operated by Tara Mapes Fine Art Photography dba Enchanted Eye Creations ("us", 'we", "our").

These Terms & Conditions ("Agreement") constitute a legally binding agreement made between you, personally, and Tara Mapes ("we", "us" or "our"), concerning your purchase and access to the Masterclass by Tara Mapes.

Services

Tara Mapes offers various masterclasses, hereafter referred to as "THE CLASS", She reserves the right to refuse sale to anyone for any reason. Student enrollment is reviewed and approved on an individual basis. An enrollment form is required and reviewed prior to approval/rejection and all payment plans require a promissory note.

The tutorials for editing are shown in Adobe Photoshop Creative Cloud 2020/2021. Actions and other digital tools were created in and for Adobe Creative Cloud Version 2020/2021. Actions require Adobe Camera Raw, this is a default tool, but you should ensure you have it installed and there are no issues.

Tara Mapes records her lighting tutorials on her cell phone and edits the final videos in both landscape and portrait modes.

Tara Mapes records the editing tutorials with professional screen recording and video editing software.

Tara Mapes' class provides multiple digital downloads in zip and standard formats. The videos will not be downloadable.

Tara Mapes' classes are not intended for anyone who currently teaches or intends to teach. When registering for a class, you are agreeing to a three year agreement to not teach any classes. Your enrollment and acceptance of these terms prevents you from teaching this or similar content, whether for free or for profit. Violations of this clause will result in action taken. Do not purchase The Class if you teach or if you intend to teach within a period of three years.

Refunds

NO REFUNDS. Given the digital nature of the class, all sales for all products are FINAL.

PAYMENT PLANS CANNOT BE CANCELLED. Any attempts to cancel will result in strict enforcement of these terms in cooperation with the banks and/or legal system.

You understand by agreeing to the terms and conditions contained herein, that you will not be entitled to any refunds for any reason. This applies to both payments in full and payment plans.

All technical issues related to your PC/software are your own responsibility. Tara Mapes does not provide IT support for other products.

If you attempt to cancel a payment plan after delivery of the course, upon receipt of the dispute, Tara Mapes will be entitled to and seek full payment, plus interest and damages in accordance with law.

Prohibited:

All product licenses are between you, the personal buyer, are for your personal use only or in the capacity as a professional photographer offering new techniques in your editing of your clients.
This class may not be purchased by those who already teach, whether for free or paid.
You agree that when purchasing a tutorial you will not recreate a similar tutorial for a minimum period of 3 years.
This content cannot be shared, recorded, screencast or similar.
This content is licensed for viewing only to the purchaser.
Access to this course will be automatically restricted and your access removed permanently if any of these terms are violated. No refunds are given on full purchases or payment plans.
You agree not to share this course or your login information with others and acknowledge if you do, you will be liable for damages, both actual and punitive.
You understand if you share your login details or the content contained any purchase made with Tara Mapes you will be removed as a student, your account will be banned, your access will be removed and you will not receive a refund. These actions do not include any legal action Tara Mapes may take against you.

Payment Plans on Masterclasses

All payment plans are subject to automatic withdrawal without notice to the customer on the due dates of the agreed upon plan. In the event of a default, you agree that your payment method on file, or any other payment methods used will be used for the purpose of bringing your account current. Defaulted accounts will have the access to the class removed and the balance accelerated. Access to class will not be restored until the full balance is paid.

Indemnification

You agree to defend, indemnify and hold Tara Mapes, Enchanted Eye Creations and any and all affiliates of Tara Mapes Fine Art Photography, dba Enchanted Eye Creations, teacher of the Painterly Pro Masterclass, harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your purchase of this class.

Communications

The entire communication with us is electronic. Every time you send us an email or visit our website, you are going to be communicating with us. You hereby consent to receive communications from us. If you subscribe to the news on our website, you are going to receive regular emails from us. We will continue to communicate with you by posting news and notices on our website and by sending you emails. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing.

Applicable Law

By visiting this website, you agree that the laws of the state of Indiana, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Tara Mapes Fine Art Photography dba Enchanted Eye Creations and you, or its business partners and associates.

Disputes

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court in Indiana USA and you consent to exclusive jurisdiction and venue of such courts.

License

All licenses are personal in nature, standard and non-commercial and between you and Tara Mapes/ Enchanted Eye Creations®. Licenses to use the content cannot be transferred, shared, redistributed or otherwise modified. The purchaser is bound by the terms of the license and cannot modify or extend the license to anyone else. This does not prevent you from offering this editing style in your sessions as a photographer, but it does prevent you from using this class and its contents to profit via teaching or redistribution or sharing access.

Tara Mapes' classes are not intended for anyone who currently teaches or intends to teach. When registering for a class, you are agreeing to a three year non compete preventing you from teaching, whether for free or for profit.

Non-Compete

NDA

By default you are agreeing to a non disclosure agreement whereby you agree not to share the details of THE CLASS with others verbally, by recording, in writing or any other method. You are agreeing that you are not permitted to distribute, redistribute, share or provide access to your student account.

User Account

If you are an owner of an account on this website, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password. If you share your password, your class access will be revoked permanently and action will be taken against you for any and all losses associated with your breach.

We reserve all rights to terminate accounts, edit or remove content and cancel orders in their sole discretion.

No Warranties; Exclusion of Liability; Indemnification

This website is operated by Tara Mapes on an "as is," "as available" basis, without representations or warranties of any kind. To the fullest extent permitted by law, Tara Mapes specifically disclaims all warranties and conditions of any kind, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and noninfringement for our website and any products or services you purchase through it. Tara Mapes shall not have any liability or responsibility for any errors or omissions in the content of our website, for products or services sold through this website, for your action or inaction in connection with our website or for any damage to your computer or data or any other damage you may incur in connection with our website.

Your use of our website is at your own risk.
